When you discover that a medical device or implant you receive is defective and could cause serious harm, you should never be faced with the prospect of a company making it difficult to secure compensation. Allergan makes Biocell textured breast implants that have been linked to a rare form of cancer. A lawsuit filed by three women alleges that Allergan is misleading women who opt to have their implants replaced. Colson Hicks Eidson is a nationally-renowned firm that is taking Allergan breast implant cases in Florida and throughout the United States.
Do Not Be Fooled By Allergan If You Have Textured Breast Implants
One of the first things a qualified and experienced product liability attorney will tell you is that you should never sign anything a negligent company tells you to sign. In many cases, when a company has manufactured a defective product, they will actively work to minimize the amount of money they have to pay anyone harmed due to their negligence. Sometimes, companies will use deceptive practices to protect their bottom line.
For years, there have been reports that textured breast implants manufactured by Allergan were impacting patients’ health. Various studies have now indicated that Allergan textured breast implants increase the risk of breast implant-associated anaplastic large cell lymphoma (BIA-ALCL). This is not a type of breast cancer, but rather a cancer that forms in the scar tissue that surrounds the textured breast implant.
In July 2019, the FDA asked Allergan to recall their Biocell textured breast implants. The agency said it had received nearly 500 unique cases of BIA-ALCL related to the implants since 2010.
In a recall letter sent to patients, Allergan offered to replace the textured breast implants with non-textured implants at no cost. However, this recall letter does not advise women that they are required to sign a release in order to get this free switch from the harmful implants. This release would effectively prevent any further legal action a woman may need to take against the company for damages. This letter also does not inform women of their rights to pursue additional claims for damages against the company. It seems that Allergan is attempting to appear gracious, but tricking women into signing a release absolving the company of any future actions they can take should they suffer harm due to Allergan’s negligent actions.
