If you find yourself in a Lyft or Uber accident while ridesharing and if you were injured, you can sue. Although these companies are supposed to ensure that their employees are quality drivers, they might fall short on the background checks and put people in danger. This is the reason why you may be able to sue not just the driver, but also the company. Call Colson Hicks Eidson at (305) 476-7400 for more information.
Video Transcription: If you’re involved in an accident involving a ridesharing vehicle like a Lyft or Uber you may have right of damages directly against those companies, not just the driver. All the people who drive for those companies are required to have a certain amount of insurance coverage, so that’s good because a lot of people driving cars that caused an injury, you know, caused an accident are uninsured. So, in this case, they’re required to have a minimum amount of insurance by law. Sometimes, though, they can be liable over and above the insurance. For example, they don’t do a good background check. They’re required to make sure that the people who are driving their cars meet a certain quality of driver—that they’re not drunks, that they haven’t lost their license, for example. All those sorts of things. They have to make sure they’re safe drivers. If there’s something in their background, and they don’t do their homework, they don’t do their diligence to make sure the drivers are safe, they can be liable over and above insurance for that. You can bring an action directly against Uber. And we have done that. We have brought a case directly against Uber because they allowed somebody to drive their own private car as part of this ride-sharing without doing the background check right. Turned out the guy was a dangerous driver. He ran a red light caused an injury and we were able to recover against Uber.
